क्या हम चोर हैं?


पिछले कई दिनों से निजी पत्र व्यवहार में स्वप्नदर्शी यह चिंता व्यक्त कर रही हैं कि हम लोग अपने ब्लॉग्स पर जो साहित्य-संगीत आदि प्रकाशित-प्रसारित कर रहे हैं उस संदर्भ में हमने कॉपीराइट उल्लंघन के पहलुओं पर विचार किया है? आज ही दिनेशराय द्विवेदी की एक पोस्ट का हवाला देते हुए उन्होंने यह लिंक भेजा है जिसके अनुसार हम सब जो इस काम में लगे हैं उन्हें सोचना चाहिये। मैं इस दिशा में किसी निर्णय पर नहीं पहुँच पा रहा हूँ। इसलिये इस पोस्ट को एक निवेदन की तरह लिया जाय। यह निवेदन ब्लॉग और इंटरनेट महारथियों से - रवि रतलामी, श्रीश, अविनाश, देबाशीश, मैथिली, सागर नाहर और जीतू चौधरी सहित उन तमाम लोगों से है जिन्होंने हमें चोरी की राह पर ढकेला है। मैं भाई यूनुस, विमल वर्मा, पारुल, अशोक पांडे, प्रमोद सिंह और उन सभी मित्रों से आग्रह करता हूँ जो पूर्व प्रकाशित साहित्य और प्री-रेकॉर्डेड म्यूज़िक अपने ब्लॉग्स या साइट्स पर अपलोड करते हैं, वे बताएं कि क्या हम सब चोर हैं? इस दिशा में क़ानूनी नुक़्तों के मद्देनज़र आप सभी अपने ब्लॉग प्रसारण और प्रकाशन की हलचलों के पक्ष में क्या दलीलें देते हैं.
जब तक इन चिंताओं पर कोई ठीक-ठाक पोज़ीशन नहीं ली जाती तब तक के लिये मैं अपने ब्लॉग पर या सामोहिक ब्लॉग्स पर अपनी ओर से ऐसी कोई भी सामग्री प्रसारित-प्रकाशित नहीं करूँगा जिसमें आइपीआर के निषेध का मसला जुडा हो.

मित्रो, मै खुद copyright act को लेकर बहुत दुविधा मे हू. आप सबके ब्लोग मै खुद बह्त पसन्द करती हू, और आप सबकी मेहनत और सबके साथ् अपनी पसन्दीदा चीज़ो को बाटने की भावना का भी सम्मान करती हू.
कई चीज़े मेरे पास भी है, जिन्हे मै आप सब्के साथ बांट्ना चाह्ती हू, और इसी सिलसिले मे मेने इरफान जी से इस् बारे मे सवाल किया.

परंतू लागातर ग्लोबल होती, डिजिटल दुनिया मे हमे copyright act के बारे मे देर-सबेर सोचना पडेगा. कई चीज़े कुछ समयावधि के बात इस नियम से परे हो जाती है, पर मुझे भारत के कानून की जानकारी नही है. इस सन्दर्भ मे दिवेदी जी की ये पोस्ट बहुत सहायता कर सकती है.

दूसरा पहलू ये है, कि अगर हिन्दी वाले इस कानून को थोडा गम्भीर् तरीके से ले तो ब्लोग मे रचनात्मक्ता नये आयामो को छू सकती है. अगर मुझे पता हो कि मेरा माल को चुरायेगा नही तो मुझे उसमे ज्यादा मेहनत करने मे कोई बूरा नही लगेगा, भले ही कोई आर्थिक फायदा न हो.

पर अगर लगातार ये डर बना रहता है तो कभी कोई फायनल ड्राफ्ट बिना प्रकाशित हुये शायद ही किसी ब्लोग पर आये.

आप सब की राय का मुझे भी इनतज़ार रहेगा. और इरफान जी का धन्यवाद इस मुद्दे को उठाने के लिये, जिसे मै इतने दिनो से उठाने से हिचक रही थी.

DONT BE OVER CAUTIOUS! KE QATL KI BHI VAHI SAZA HAI JO HAZAR KI HAI. U MUST REMOVE THIS POST AS IT MAY BE OFFENDING FOR MANY AND I PERSONALLY GIVE A DAM TO COPYRIGHT . RANG ME BHANG NA KARO YAAR. NO BLOGGER IS DOING IT COMMERCIALLY.

मुझे लगता है कि समीक्षात्मक दृष्टि से किसी भी रचना का उपयोग , मूल रचना के संन्दर्भ के साथ, अपराध नहीं है. फिर भी मुझे इस विषय पर कानूनी नजरिये की तलाश है.

chori vaaley nazariye se to kabhi dekha nahi...divedi ji ka lekh padhkar kaafi soch me pad gayi huun...aajtak to maqsad sirf yahi rahaa hai ki apni pasand ko doston ke saath share karuun..aur unki posts ke maadhyaam se kuch nayaa sun sakuun...ab aagey kyaa..ye auron ki raai ke baad....

बहुत दिनों बाद आज ब्लाग जगत पर एक ऐसी बहस या मुद्दे की शुरुवात देख रहा हूँ, जिसमे मुझे लगता है सभी ब्लोगर बंधू बिना किसी पूर्वाग्रह के शामिल होना चाहेंगे और इसका जो हल निकलेगा उसका लाभ सभी को बराबर मिलेगा.

वैसे इन सब मामलों में हम आपके मौसेरे भाई बनने को तैयार हैं लेकिन आप हैं कि बनते ही नहीं ... :-)

इरफ़ान भाई,कॉपीराईट को लेकर मैं भी भयंकर दुविधा में हूं और आपकी इस पोस्‍ट ने दिक्‍कतें और बढ़ा दी हैं । मेरा तर्क ये है कि हम इसका कमर्शियल उपयोग नहीं कर रहे हैं । हालांकि कॉपीराईट एक्‍ट तो शौकिया उपयोग की भी इजाज़त नहीं देता । आप ही बताईये क्‍या किया जाए । 'एक शाम...' वाले मनीष जब मुंबई आए थे तो मैंने उनसे भी इस संदर्भ में बात की थी । लेकिन ये मामला उलझा हुआ-सा लगता है ।

For those thinking to avoid this conflicting issue by saying that they
are using it for comercialization. I am sure the legal experts will
concur with me here. By putting the materail on your website and blogs
without the prior permission of teh person or the holder of the
rights, you have infringed on their right because, instead of them
(authors and/or publishers) selling their product by way of
publication in the form of books, LPs, music downloads and albums from
their company and/or personal publications or website, people
(consumers) have unrestricted right to get it from you. Means the
product they (authors and publishers) would have sold and made money
on it directly is not being sold now because someone else (you) is/are
providing it. Therefore all those posts you have generated calls upon
the infringement of the law and would go in the favor of the
publisher.

Swapandarshi said it nicelly that to avoid the copyright or rather any
other rights infingement, you should work on creating your own
material and since you all are so much in the liking of allowing users
and others to use it for non-commercial purposes, therefore instead of
copyright, the best option for you is to put your blogs in the
creative commons liscence (http://creativecommons.org/).

ये बहस पहले भी हो चुकी है हालाँकि ब्लॉगों पर शायद नहीं. मई 2006 के आसपास मानव संसाधन मंत्रालय ने कॉपीराइट कानून में संशोधन के लिए सुझाव आमंत्रित किए थे. RMIM न्यूज़ग्रूप पर गानों के बोलों को नेट पर डालने से संबंधित एक चर्चा में मैंने जो लिखा था उसे ही कुछ जोड़-घटाव के बाद सीधा अंग्रेज़ी में उद्धृत कर रहा हूँ:

The website of Copyright office of Ministry of HRD gives more accurate and detailed information. They have also provided means to submit comments on the proposed amendments. As for proposals themselves, a PDF document describes the proposed changes in full detail. The document can be seen here:

One point in the document that is relevant to our discussion here is the one that deals with exceptions to infringements viz. #19. Here are some exceprts:


19 a.
Earlier:
(a) a fair dealing with *{ a literary, dramatic, musical or artistic }* work [not being a computer programme] for the purposes of-
(i) private use, including research;
(ii) criticism or review, whether of that work or of any other work; "
(1) The following acts shall not constitute an infringement of copyright, namely:

Proposed amendment:
(a) a fair dealing with any work, not being a computer programme, for the purposes of-
(i) private and personal use, including research;
(ii) criticism or review, whether of that work or of any other work;
(iii) the reporting of current events, including the reporting of a lecture delivered in public;

Explanation: The storing of any work in any electronic medium for the above purposes, including the incidental storage of any computer programme which is not itself an infringing copy for the said purposes, shall not constitute infringement of copyright.


Point (ii) should make the way clear for posting of lyrics and discussions on them on groups like RMIM. On blogs too, if a copyrighted material is used for commentary or review, it should be deemed a "fair dealing" by this point.

But I am no lawyer and I don't know in what possible ways the act can be interpreted.

In any case, the amendment changes very little: it adds "personal" to private in point (i), and adds point (iii) and the explanation. The added explanation actually only helps, since it allows the electronic storage of such works.

Here's another point that has been added as part of the amendments:


(c) (i) the transient and incidental storage of a work or performance purely in the technical process of electronic transmission or communication to the public;

(ii) such transient and incidental storage for the purpose of providing electronic links, access or integration, where such links, access or integration has not been expressly prohibited by the right holder, unless the person responsible is aware or has reasonable grounds for believing that such storage is of an infringing copy; Provided that if the person responsible has
prevented the storage of a copy on a complaint from any person, he may require such person to produce an order from the competent court for the continued prevention of such storage.


Point 19 (j) is the one that deals with the remix/version issue.

Here's what I think about the whole issue:

Fair use of such works should be encouraged, especially in
the Indian context where the system and state of instituitional
archival of old, rare, obscure (or for that matter all kind of) works
is very poor. The copyright holders and the recording companies do little to make things better. Most of the time, the copyright holders do not even care for preservation of the work.

Unless and until affordable and universal availability of most such work in modern storing formats and platforms (including Internet) is assured, any restrictions on fair use and non-commercial activities will not only not work, but can backfire (by making some work lost for ever). The amendments (or the act itself) don't seem to talk a lot about fair use, let alone encourage it.

did you create it or did you borrow it from someone. There is no mention about it. So are many other things that do face infringements, due to lack of citations.

We are enjoying the creations of others but do not want to pay for the same. I can understand posting old vintage songs which are not commercially available. But instead what I am finding that the songs are being posted which are easily available in the market. If one is so lazy or selfish that he/she does not want to go to market on on net to purchase the music he has no right to consider himself/herself a music buff. How can we expect old and vintage music become available commercially if there are no takers as every one wants to listen them on net.
Unfortunately there are signs of Chori aur Seenajori.

i find allthis discussion disgusting. u have made others apprehensive , overcautious and may be afraid of sharing good things with friends. u and swapndarshi r behaving like spoilsports ! if u did'nt want to share songs u cud have done it silently but u r hell bent on turning a beautiful blog like urs
in something crap like BHADAAS or some other behas ka adda . karo bhai behas. main yahan aana band kar raha hoon. gud bye.sasta sher hi theek hai yaar.

Mr. munish, if you expect others to reepect and appreciate your work, then start appreciating the works others have done and give them due credit. Either pay r acknowledge their contribution. If a senior blogger like you react in a seeminly negative way and do not understand the ethics and rights issue then you lose the right to even put your negative views. There is no end to the irresponsible thinking. Start underatnding the issue we are disucssing here and seek legal help to make sure the work done by so many of the bloggers so far continues to develop in the same fold or may be even in a better brighter way.

मैं कुछ दिनों से व्यस्त रहा, कुछ प्रोफेशनल और कुछ पारिवारिक व्यस्तता। इस कारण से अपने ब्लॉग पर लिख नहीं सका। जिस तरह के कमेंट्स कॉपीराइट वाली पोस्टों पर आए उन से लगा कि शायद लोग इसे गंभीरता से नहीं ले रहे।
हुआ यह कि कॉपीराइट की चर्चा कहीं ब्लॉग पर हुई, नोटिस भी शायद दिए गए, मुझे लगा कि जो लोग धड़ाधड़ अपनी कृतियाँ प्रकाशित किए जा रहे हैं उन्हें इस कानून की जानकारी होनी चाहिए। मैं ने इस कानून के कुछ महत्वपूर्ण अंशों का हिन्दी अनुवाद किया और उसे अपने ब्लॉग पर प्रकाशित किया। कॉपीराइट के मूल अंग्रेजी कानून का पूरा पाठ भी उपलब्ध कराया। सोचा, इस से सोचना तो आरंभ होगा। कॉपीराइट एक्ट का मूल उद्देश्य कृतिकारों की मौलिक रचनाओं पर उन के अधिकार की रक्षा करना है। अगर हम वास्तव में कृतिकार हैं तो हमें इस अधिकार का सम्मान करना ही चाहिए। हम बिना पूछे, बिना बताए धड़ल्ले से दूसरों की कृतियों का मनमाना उपयोग करते चले जाएं यह अच्छा नहीं।
अच्छी बात यह हुई कि इस पर सोचना आरंभ हुआ। अभी तक मैं ने इस कानून के किसी भी पक्ष पर अपने विचार नहीं रखे और न ही उसे व्याख्यायित करने का प्रयत्न किया।
समीक्षा और किसी भले काम के लिए किसी कृति के अंशों का सदुपयोग करना कहीं भी कॉपीराइट कानून का उल्लंघन नहीं है। लेकिन इन बातों को विस्तार से समझना जरुरी है। अब जब विमर्श आरंभ हो ही गया है, मैं भी कुछ लिखूंगा ही। अभी तक जो कुछ भी मैं ने अपने ब्लॉग पर लिखा है वह पर्याप्त नहीं है। एक महत्वपूर्ण हिस्सा छूटा हुआ है। वह है इस कानून में इस्तेमाल किए गए कुछ विशिष्ठ शब्दों की परिभाषाएं। इन्हें मैं एक दो दिनों में ब्लॉग पर डाल रहा हूँ। इस के बाद ही विमर्श चले तो ठीक।
जहाँ तक चोरी का प्रश्न है। इतना बता रहा हूँ कि अगर आपने कृतिकार का उल्लेख करते हुए किसी कृति का उपयोग किया है तो वह कम से कम चोरी तो नहीं है, कॉपीराइट का उल्लंघन भले ही हो। इस कारण से अपराध बोध न पालें।
इतना निवेदन और कि संभवतया पूरी कृति का उपयोग करने से बचें, कृतिकार का आभार जरुर व्यक्त करें और अपने कॉपीराइट की रक्षा के बारे में सोचते हुए दूसरे के कॉपीराइट वाली कृतियों का इस्तेमाल करें।
